LogoQuicker Terms of use

Please carefully read the "Terms of use" that govern the use of Logoquicker web site:

1 General
The Logoquicker is a web site, also defined as www.logoquicker.com, which allows the users to order logo design, conversion of logos and other objects from 2D vector files to 3D files and other graphic design services. Both, the brand LogoQuicker and the web site are property of Art Studio Radevs Ltd.

2 Agreement
2.1. This is the Agreement between any person or company using the services of Logoquicker defined as “User” (also defined as ‘you’, ‘your, ‘yours’) and Art Studio Radevs Ltd. UIC: 204612776, Sofia, Bulgaria, via its web site www.logoquicker.com providing the design service, defined as “Web site” (also defined by ‘us’, ‘our’, 'Logoquicker', www.logoquicker.com')
2.2 The use the services of Logoquicker web site by the User is subject to the agreement and compliance with the terms which are listed in this Agreement. Any disputes resulting from this agreement are governed by the laws of Republic of Bulgaria.
2.3 When placing any design order in the Logoquicker web site, you confirm that you accept and agree with these terms and that you are of eligible age to enter in this agreement (eighteen 18 years old at least).

3. Changes and amendments to the Terms of use
3.1 Logoquicker can do changes in any time to these Terms of use and will publish such changes on the Logoquicker web site - www.logoquicker.com
3.2 Any changes done on the Terms of use will be effective as of the moment of publishing them on the Logoquicker web site: www.logoquicker.com
3.3 When you, the User continue the use of Logoquicker web site services, you automatically agree with the changes done in this Agreement.

4. Term of the Agreement
4.1 The Agreement between the User and Logoquicker web site starts from the date an order is placed by the User and is terminated once and order is completed:
A) when the Logoquicker web site provides the User with source files in vector or 3D format according to the project via email,
B) when you send a written notice that you, as a User are not interested to work further with Logoquicker, and that you as a User confirm that will not use in any way, any of the graphical materials provided to you by Logoquicker team via email or other means.
5. Services provided
5.1. Logoquicker provides design services to the User who has filled in detail the order forms for order of logo or 3D logo conversion
5.2 When Logoquicker receives an order, the Site is obliged to reply to the User via email within 72hrs of receiving it, unless there are public holidays or unpredictable circumstances that cause a longer delay. The moment of receiving the order is considered during working hours (9:00 to 18:00) Bulgaria time.
5.3 When User order is received via Logoquicker web site, it has the right to:
a) Accept the order and start work on it,
b) Request more detailed information from User via email, in order to be able to start work
c) Refuse order if request in our view breaches any terms or copyrights of third parties or any other specific reason depending on the order and moment of placing it.
5.4 Logoquicker will do its best to provide the User a unique logo design. However, due to the enormous number of logos and symbols worldwide, Logoquicker web site cannot guarantee that the logo provided will not have a similarity to a logo of another brand around the world. Although Logoquicker will do its best to provide a logo, which is as unique as possible, Logoquicker cannot take any financial or other responsibility, for claims towards Logoquicker or to the User by third parties, if any other similar symbol, or shape exists elsewhere in the world. For this reason, the User is responsible to notify immediately if there is any such similarity that may breach copyrights of third parties, before the completion of a project. If the User finds and proves such similarity after a logo project is completed, Logoquicker will do its best to re-work in reasonable time the selected logo design, so it does not breach any copyrights and provide a new set of source files.
5.5 A) When User provides source files for converting in 3D, the User confirms the possession of copyrights over the provided files, and by sending them to Logoquicker agrees to give the right to Logoquicker for edit and transfer these files into 3D formats.
B) When User provides any sample logo files for inspiration and example of what is requested by Logoquicker, User agrees that he/she will not lead Logoquicker web site to provide designs that breach any copyrights of third parties in any way.
5.6 Fonts used in designs by Logoquicker are either fonts free for commercial use, or fonts for which LogoQuicker has acquired the right to use for commercial purposes. In cases where User requires a specific font which is not free for commercial use, the User will have to acquire separately the license of the font as well as acquire license for use for Logoquicker, according to the specific case and a mutual agreement.

6. Order and work process
6.1 The User places an order for design work via the Logoquicker web site www.logoquicker.com different order forms.
6.2 Orders can be
A) For new logo design
B) Converting a ready logo of the User in 3D file format
C) Other design work
D) Consulting services

6.3 Logo Order process
A) When the order is received Logoquicker proceeds as per 5.3 above
B) After the order is processed the User is required to pay a commitment fee of $50 before receiving first designs. In case the User does not like any of the first proposed logos, Logoquicker will return this amount. However, in case the User wishes to continue and finalize the project, the fee will be deducted from the package price upon project completion and final payment. In case the User decides to stop work on the project in any stage after first revision, Logoquicker will not return the fee and invoice the user for $50, plus % of the logo project price, depending on the amount of work done up to this moment.
C) When order is accepted, Logoquicker notifies the User by means of email about that, providing brief details on the work process
D) Within reasonable time from accepting the order, and after receiving the commitment fee, Logoquicker provides first Draft logo designs which are placed on a Logoquicker template and contain copyright protection mark of Logoquicker web site.
E) After receiving first Drafts, the User is obliged to return feedback on what changes he/she want to see on only ONE of the provided drafts, which User likes most, or to notify immediately Logoquicker that he/she is not interested to work with Logoquicker further. In such cases, the User is NOT allowed to use any of the ideas, shapes, design elements or fonts and font styles, which were provided by Logoquicker, for the brand of the User in indefinite time in the future, and the site will return back the commitment fee paid by the User earlier.
F) If LogoQuicker does not receive any feedback from the User within one month of drafts provided, it is considered that User is not interested in any of the designs and Logoquicker has the right to offer them or parts of them to other users. In such cases, the User is NOT allowed to use any of the ideas, shapes, design elements or fonts and font styles, which were provided by Logoquicker, for the brand of the User in indefinite time in the future. In this case, Logoquicker is not obliged to return the commitment fee, without written notice from the User.
G) The User has the right to ask for a reasonable, but not limited amount of revisions of the only ONE design liked most, until fully satisfied with the final logo design.
H) Once the User selects a final revision of the logo, Logoquicker will invoice the User for the work done and send source files in vector and raster formats, within 72hrs of payment, unless there are public holidays or other unexpected conditions for which Logoquicker web site will notify the User.
6.4 3D convert process
A) When the order is received Logoquicker proceeds as per 5.3 above. In order to proceed, the User has to supply a logo in one of the vector formats: .ai, .eps, .pdf .
B) Depending on the complexity and shapes of the logo provided by the User, Logoquicker will reply on whether it is possible to convert to 3D and in what conditions this can happen.
C) Once informed by email the User can accept or reject the offered conditions by Logoquicker.
D) Once accepted, Logoquicker will proceed with the order after receiving а commitment refundable fee of $50. Once ready a raster jpg or png file preview will be presented to the User for approval.
E) If accepted by the User, Logoquicker web site sends an invoice to the User for the agreed amount as per 6.4 C. Once paid, Logoquicker web site provides the 3D files to the User in .stl or .obj format, depending on what os agreed with the User at the start of the project.

7. Payment
7.1 Logoquicker provides design services where:
A) The User is obliged to pay the announced and agreed price for logo design or 3D logo file generation, prior to receiving final source files.
B) In cases where the User requests changes to the first drafts received, but after receiving revision requests to stop work, since design work cannot be returned back, the User is entitled to pay Logoquicker for the work done so far, or a minimum of 50% to 70% of the announced and agreed price, depending on the amount of work done up to this moment.
C) In cases where the User is not satisfied with first drafts received and requests to stop work before any revisions, the User will receive back the commitment fee paid by the User at the start of the project.
D) In cases, as per 7.1 B and 7.1 C, Logoquicker keeps full copyright over the created so far content and keeps the right to use all or parts of the graphical content in any other project.
7.2 Logoquicker is obliged to provide preview of the work done in watermarked raster format (.jpg or .png), as an approval to the User of the work done so far, prior to payment.
7.3 Following the payment of the User, Logoquicker is obliged to provide via email source files where:
A) For logo design they are in the following raster and vector formats: .jpg, .png, .eps, .ai and .pdf.
B) For 3D logo conversion in .stl or .obj formats.
7.4 Payments are done to the bank account of Art Studio Radevs Ltd. bank account or PayPal account, after Art Studio Radevs Ltd. has issued an invoice for the work done.
7.5 When doing the payment, the User is liable for all local taxes, duties or fees for the expense done.
7.6 Logoquicker issues invoice only for the logo design work and 3D conversion work.
7.7 Copyrights only of the one design selected by User are transferred to the User only after full payment is completed. Copyrights are transferred from Art Studio Radevs to User by this agreement at the moment of payment and Art Studio Radevs Ltd. is not obliged to sign any other copyright transfer documents. Art Studio Radevs Ltd. keeps the right over any not selected by the "User" designs, all or parts of it for future use in other projects.
7.8 All payments must be made in Euro, US dollars, British pound or Australian dollars.
7.9 Art Studio Radevs Ltd. has the right to cancel an order and not provide source files in cases of attempt by User to pay with stolen card, bank account or PayPal identity, where rights of the source files are not transferred to User either in case this is proven by PayPal, banks or authorities in charge of investigating.

8. Confidentiality
8.1 All information and files provided by User to the Site will be used only for the purposes of logo design or 3D logo conversion and will not be shared to third parties. Logoquicker site declares that will do its best to keep the privacy of information provided, but cannot be kept liable if information is taken without the will and understanding of Logoquicker, as a result of cyber attacks or similar unauthorized deeds of third parties.
8.2 The User is solely responsible for the content provided to Logoquicker site, and declares that owns the full copyrights of any content provided as sample to follow by LogoQuicker.

8.3 The User is obliged to inform Logoquicker prior to start any work, if User has any confidentiality requests, requests to sign NDA agreements sent by User or any similar. Art Studio Radevs Ltd. keeps the right to refuse to sign and agree prior to work start and therefore refuse to work on a project.

8.4 The User is fully responsible for the information provided to Logoquicker prior and during the work process and its level of confidentiality.
8.5 Art Studio Radevs Ltd. will not sign, provide or agree on any NDA or similar agreements, if such is requested or provided by the User after work has started on a project.

9. Definitions
9.1 Logo - the graphical brand element presented to the client visually. As opposed to illustration, the logo focuses on a rather simple way to present the message of a brand.
9.2 3D logo - 3-dimensional graphical logo version created in 3D software to be used for animation or print purposes. The 3D logo has depth and light effects to give an impression of a real object.
9.3 User - any person, or company represented by person to use the services of Logoquicker web site.
9.4 Order - An online form, filled out by Lopgoquicker User to present the interest of this User to create a new logo for a brand or convert a logo in a 3D shape
9.5 Vector files - files created in a vector file format, such as .ai, .eps or .pdf, which keep the logo in a constantly high resolution for print or other use.
9.6 Raster files - files in .jpg or .png formats, to be used for on screen or web purposes. The raster files have a limited size, which when increased, decreases the quality of the image.
9.7 3D files - files generated in a 3D software in .stl, .obj or .3ds formats to be used for 3D print or animation purposes.
9.8 Source files - the set of source files presented from Logoquicker to the User after completing the project. Source files contain the vector formats .ai, .eps, and raster formats .jpg and .png for Logo projects and .stl or .obj files for 3D logo convert projects.
9.9 PayPal - international online payment system, with options to pay with cards and issue invoices
9.10 Drafts - starting graphical presentations of the first logo options presented by Logoquicker. Drafts are presented only in raster .jpg or .png formats, on a Logoquicker watermarked template. Drafts cannot be used by the User in any way, before project is completed and User has paid for tranfering the copyrights.
9.11 Revisions - Revisions are graphical presentations of logos, based on the drafts or other revisions and done as per the request for changes of the User. Revisions are presented only in raster .jpg or .png formats, on a Logoquicker watermarked template. Revisions cannot be used by the User in any way, before project is completed and User has paid for transferring the copyrights.
9.12 Selected design - is the logo design chosen by the User as final design, for which Logoquicker prepares final source files. This is the only design for which the User acquires the copyrights for use, where the copyrights of any previous revisions and versions presented to the User, remain owned by Logoquicker.
9.13 Cyber attack - any attempt by an unauthorized user to, break in the source of Logoquicker web site, affect its functionality in any possible way, steal information presented by User or other criminal deed, for which it harms both the Logoquicker web site and its Users.
